Why Eric Swalwell may actually have a winnable case against Trump

Well, impeachment was a bust. And Republicans don't seem any closer to holding former President Donald Trump accountable for his role in inciting the Jan. 6 attack on the Capitol. So Rep. Eric Swalwell, D-Calif. is taking him to court.

In a new civil suit, Swalwell wants a court to find that Trump and several of his cronies broke the law ahead of the Jan. 6 rally that preceded the attack. "Swalwell has taken a smart approach here by coming forward with a suit that is broader, and perhaps more winnable than one that merely asserts that Trump incited the insurrection," Jessica Levinson writes. But Trump has faced legal challenges before and come out unscathed — will Swalwell's case be the exception?
