In early 2022, the Drug Enforcement Administration (DEA) sent a reply letter to an inquiry by Vicente Sederberg’s Shane Pennington, clarifying that cannabis seeds—which contain less than 0.3 percent THC on a dry weight basis—are in fact legal under the 2018 Farm Bill. The news was considered a surprising yet tepid win for the industry, where licensed growers and breeders have faced difficulties selling and acquiring genetics under stringent regulations in some states, and a “don’t ask, don’t tell” policy in others, while selling seeds to the public for home growing was allowed only under certain state-legal cannabis programs. The DEA’s letter has therefore created a state-federal disconnect.
