CRC Member Exclusive | New York Appellate Court: Unattributed statements in meeting minutes are not privileged | The Supreme Court of the State of New York, Appellate Division, Second Department (the "Court") recently ruled that parts of a hospital peer review committee's meeting minutes were not entitled to the state's quality assurance privilege. Due to an exception in that privilege, statements made by a physician who is party to a malpractice lawsuit are not protected from disclosure (the "party-statement exception"). |
