As the drama of the Kavanaugh confirmation comes to a head in Washington this weekend, the stakes are high for the power sector.

Industry lawyers told Utility Dive back in July that placing Kavanaugh on the high court could put a number of environmental regulations at risk and even threaten the underpinnings of the Federal Energy Regulatory Commission.

In past decisions, Kavanaugh "called into question the entire concept of the modern independent regulatory agency," one energy lawyer said. "That is extreme judicial activism."
