In today's CMU Daily: The US government has sued Live Nation in New York, but the live giant says the lawsuit should be heard by a court in Washington DC. Thatā€™s because a consent decree that regulates Live Nationā€™s conduct is under the jurisdiction of the DC courts, but the Department Of Justice says thatā€™s irrelevantĀ

Live Nationā€™s anticompetitive conduct goes far beyond consent decree violations, the US government argues

The US Department Of Justice has formally responded to efforts by Live Nation to move the lawsuit it filed against the live giant from a court in New York to a court in Washington DC.


Where the lawsuit will be fought out all comes down to the relationship between the DoJā€™s lawsuit and the consent decree that was agreed by the DoJ and Live Nation in 2010, when Live Nation merged with Ticketmaster. The consent decree sought to allay competition concerns raised by the merging of the major promoter and venue operator with the ticketing business.Ā 


The new lawsuit accuses Live Nation of anticompetitive conduct and ultimately aims to reverse the merger, forcing a sale of Ticketmaster. Live Nation therefore argues that the new lawsuit basically ā€œseeks to modify or enforce a prior consent decreeā€. Which means the legal battle should be hard by the DC court that oversees the 2010 agreement.Ā

Patreon creators will have to pay Appleā€™s 30% commission on iOS subscriptions from November

Artists and other creators who sell memberships or subscriptions through Patreonā€™s iOS app will have to start factoring in Appleā€™s 30% transaction fee from November, either swallowing the cost or passing it onto their members and subscribers.


Patreon was previously able to direct in-app transactions within its iOS app to third payment providers, meaning no commission was due to Apple. However, last year the tech giant decided that the Patreon app must now comply with its often controversial App Store rule that says transactions relating to digital content must be processed via Appleā€™s own commission-charging payments system. That rule will be enforced on new subscription payments from November.Ā 


ā€œUnfortunately, Apple is requiring us to switch over to their in-app purchase system for all iOS transactions or else risk being kicked out of the App Store altogetherā€, Patreon said in a message to creators yesterday. As well as having to pay Appleā€™s commission, some creators will have to change the payment options they offer their subscribers, the message added, because Appleā€™s ā€œin-app purchase system is not built with our same level of creator-first flexibilityā€.
