#1 UNITE HERE Dispute with Sky Chefs Back on the PlateLos Angeles, CA - UNITE HERE International Union's California labor lawsuit against Sky Chefs Inc. is back on the plate. The Ninth Circuit ruling in December reversed U.S. District Judge Percy Anderson's dismissal in May 2022 of the Union's lawsuit which challenged unilateral wage and benefits changes made by the airline catering company on its employees at Los Angeles International Airport.
#2 $120M awarded in Westchester Medical Center Medical Malpractice LawsuitWestchester County, NY – A state Supreme Court jury last November awarded $120 million in a medical malpractice lawsuit against Westchester Medical Center. In 2018 the plaintiff was rushed to hospital and because doctors failed to diagnose a stroke, he suffered extensive brain damage. The hospital argued that brain damage had already occurred before he was admitted.
#3 Hair Relaxers – Read the LabelChicago, IL - Black women who have used hair relaxers for most of their lives have been “shocked” and “horrified” to discover that studies have linked formaldehyde—the chemical found in most hair relaxers—to cancer and fibroids. A recent Boston University report highlights an increased risk for Black women to develop uterine cancer after receiving a particular hair treatment, but studies suggesting that hair products containing a variety of chemicals are linked to asthma, hormone disruptions and even cancer go back to 2018.
#4 Seroquel Side Effects for the ElderlyPearblossom, CA - Seroquel is a neuroleptic indicated for the treatment of bipolar disorder—and like most drugs carries a host of Seroquel side effects, including diabetes, tardive dyskinesia and even birth defects. However, there is a little-known use for Seroquel off-label that concerned the daughter of one Alzheimer's patient for whom she was caring.
#5 Zetia and/or Statins: The Good, the Bad and the UglyHalle-Wittenberg, Germany - Can a drug designed to curb heart attacks also cause heart attacks in some people? Apparently, it's possible with statins or medication like Zetia when used in combination with a statin. Statins are designed to lower the "bad" cholesterol thought to be a contributing factor for heart attack and stroke, while leaving the so-called "good" cholesterol to do the good work that good cholesterol, ultimately, does.
#6 Are Forfeiture Lawsuits the Next Trend for ERISA Litigation in 2024?Oakland, CA - On December 13, Clorox Co. asked the Northern District of California to dismiss a class action ERISA breach of fiduciary duty lawsuit that targets the company’s longstanding practice of using forfeited employer contributions to participants’ accounts to reduce its required contributions to the plan. Plan participants argue that forfeited amounts should instead be used to defray the plan’s administrative expenses.
#7 $155 Million Overtime Settlement Approved for Prison SupervisorsSan Francisco, CA - A $155 million overtime settlement filed by current and retired California prison supervisors has been approved by a San Francisco Superior Court Judge. The original California labor lawsuit, dating back to 2008, alleged unpaid overtime wages for tasks performed before and after their shifts.
#8 Johnson & Johnson to Pay $700 Million to Settle State AG LawsuitsTrenton, NJ - Johnson & Johnson has reportedly agreed to pay $700 million to settle talcum powder lawsuits brought by 42 states. These state lawsuits allege that the company wrongfully marketed a product that it either knew or had reason to know was dangerous to human health.
#9 Equinox $36 million settlement for California Wage and Hour LawsuitsAlameda, CA - Equinox has agreed to pay $36 million to resolve two California labor lawsuits alleging the fitness company required more than 15,000 employees to perform pre-shift work without pay and to skip meal breaks. The settlement, which resolves California state and federal actions, covers those who worked for Equinox in California between April 3, 2015, and Dec. 31, 2022.
#10 Nurses Filed Unpaid Wages Lawsuit Against U.S. Nursing CorpDenver, CO - Two nurses last month filed a proposed class action against U.S. Nursing Corp, claiming they were underpaid while filling in for workers on strike at Kaiser Permanente South Bay Medical Center last October. And it’s not the first class action facing U.S. Nursing.
