#1 ERISA Lawsuit Against UnitedHealth Subsidiary Gets Class Action StatusMadison, WI On December 15, the District Court for the Western District of Wisconsin agreed that plaintiffs in a lawsuit against UMR, the benefits administrator for employer-sponsored UnitedHealth insurance plans, could proceed as a class. As many as 1,600 individuals may ultimately be included in ERISA lawsuit. This appears to have weighed heavily in the Court’s decision that Berceanu v. UMR, Inc. could proceed as a class action lawsuit.

#3 UPS Hit with Federal and California Labor LawsuitOakland, CA On November 9, Galena Goins, Sonia Lopez, and Terry A. Jones-Jackson filed a nationwide class action and collective lawsuit in the District Court for the Northern District of California alleging that their employer, United Parcel Service, systematically discriminated against them and women similarly situated on the basis of gender, age and disability. They claim that UPS violated federal and California labor law.
#4 Lisinopril Associated with Many Serious Side Effects, Including Angioedema and Liver DamageHouston, TXLisinopril, used to treat hypertension, congestive heart failure and heart attack, is associated with many side effects including liver damage. Beverly was diagnosed with angioedema (which can be life-threatening) as a direct result of Lisinopril, according to her hospital doctors.

While Reglan (metoclopramide) has proven effective to lessen the symptoms of headaches, patients need to be aware of Reglan side effects—not the least of which is tardive dyskinesia.
#6 Maker Of “Neuro” Drinks Agrees To Pay $500,000 In Fines and Restitution Neurobrands LLC, the Santa Monica-based maker of the “Neuro” line of drinks, has agreed to a permanent court injunction that requires it to change its marketing practices. The company will also pay $500,000 in penalties and restitution as part of a settlement with local prosecutors.
#7 Dentists Warn Patients About FosamaxHonolulu, HI Jasmine had a clean bill of health from her dentist, not even a cavity in 54 years. But last year she had a wisdom tooth removed and her oral surgeon said she is suffering from “dead jaw,” which is a bone disease. Her dentist said that Fosamax is to blame.
#8 Bronson Healthcare to Settle Excessive Fee ERISA LawsuitKalamazoo, MI Bronson Healthcare and participants in the Bronson Healthcare Group, Inc. 403(b) Tax Sheltered Matching Plan have agreed in principle to settle a proposed class action ERISA lawsuit. The lawsuit focused on the fiduciaries’ decision to include the actively-managed Fidelity Freedom Fund in the plan’s investment portfolio. Details of the proposed settlement have not been disclosed.
