In today’s CMU Daily: The US Motion Picture Association has made a submission to a US government consultation on foreign trade barriers including some comments on AI. It asks the government to put pressure on countries that have or want copyright exceptions for AI training, insisting copyright owners must always have an opt out


Also today: Lil Durk could face a life sentence after being charged over allegations he paid for the attempted murder of rival rapper Quando Rondo. It’s claimed associates of Durk and his collective OTF travelled to LA with the intent of murdering Rondo in retaliation for the killing of OTF rapper King Von


Plus: Earlier this year, when Providence announced it was selling festivals company Superstruct Entertainment, rival equity firm CVC was tipped as a possible bidder. In the end another investment outfit, KKR, bought Superstruct, but CVC has now acquired a stake in the business

Hollywood studios say AI training opt-out critical, Singapore must clarify copyright rules

Hollywood’s trade body has asked the US government to put pressure on any countries considering introducing new copyright exceptions that benefit AI companies - like, for example, the UK - to ensure that they include “effective and non-burdensome” opt-outs for rights owners. 


It also wants Singapore, the country most frequently referenced for already providing a wide-ranging copyright exception for AI training, to provide more clarity on how its exception works and to also allow rightsholders to opt out. While Singapore provides AI companies with a copyright exception, there is a risk those companies will just base themselves there to avoid copyright obligations in other countries. 


“With the rise and increasingly wide usage of generative AI technologies, certain markets, notably Japan and Singapore, have passed expansive text and data mining (TDM) exceptions in their copyright laws”, the Motion Picture Association writes in a submission to the US Trade Representative. 


“These exceptions”, it adds, “allow use of online data (including from copyrighted works) to train AI datasets, including both commercial and non-commercial uses, in an overly broad manner”. However, it says, Japan has provided some "”helpful clarity” that mitigates the negative impact of its TDM exception, to an extent. And Singapore should follow its lead.


Unless the movie and music industries can get additional ‘access to market’ rules added to copyright law...

Lil Durk charged over alleged murder-for-hire revenge plot

Grammy winning rapper Lil Durk was arrested in Florida last week, “as he attempted to leave the United States”, over allegations he paid for the attempted murder of rival rapper Quando Rondo in 2022, instigating a shooting in which Rondo’s cousin Saviay’a Robinson was killed. 


It follows the filing of a lawsuit earlier this month, also involving Universal Music and Sony Music, which claims that Durk’s rap collective Only The Family - or OTF - “serves as a hub for the O-Block criminal enterprise and street gang” in Chicago, basically operating as the gang’s “media outpost”. 


There are parallels to the long-running Young Thug prosecution, where prosecutors claim his label YSL is a front for a criminal gang. 


That O-Block gang gets its name from Chicago housing complex Parkway Garden Apartments, which was dubbed ‘O Block’ after murdered gang member Odee Perry. In January of this year, a Chicago federal jury convicted six “members or associates of the O-Block gang” on racketeering charges, including the 2020 murder of Carlton Weekly, a Chigago rapper known as FBG Duck.


Commenting on last week’s arrest, Martin Estrada, US Attorney for the Central District Of California, says that Lil Durk, real name Durk Banks, is charged with “orchestrating a cold-blooded murder that resulted in the death of a rival’s family member”, adding “the shooting occurred in the open, at a gas station at a busy intersection, endangering many others in the area”.

CVC takes stake in KKR owned Superstruct Entertainment

Private equity outfit CVC has bought a stake in festival owner Superstruct Entertainment, which was acquired by investment firm KKR earlier this year.  


CVC hasn’t declared the size or value of its stake in the company which operates events like Sonar, Benicàssim, Sziget, Bluedot and Boardmasters. It simply says it’s investing “alongside KKR” to support the festival company’s “next phase of development as one of the world’s premiere live entertainment groups”. 


The investment, it adds, “positions Superstruct to accelerate its mission of creating best-in-class live experiences, working closely with entrepreneurs, creative visionaries and business-minded professionals”, while “driving innovation and setting the standards for live entertainment”.


Superstruct was set up by equity firm Providence and Cream founder and former Live Nation exec James Barton in 2017, going on to acquire a significant portfolio of events, so that it now runs 80 music festivals across nine European countries and Australia, with a potential reach of seven million attendees each year.
